ONERGY – Terms & Conditions / End User License Agreement (EU

Welcome to ONergy (“App”, “Service”).
These Terms & Conditions and End User License Agreement (“Terms”, “Agreement”) govern your use of the ONergy mobile application, wearable integrations (including BrainBit and compatible devices), website, and all related services provided by NOSOK LLC (“Company”, “we”, “us”, “our”).

By downloading, installing, or using ONergy, you (“User”, “you”) agree to be bound by these Terms.
If you do not agree, do not use or access the App.

 You must be:

• at least 16 years old (or the age required in your country), 
• legally capable of entering into this Agreement. 

Parents/guardians are responsible for minors who use the App.

 We grant you a limited, non-exclusive, non-transferable, revocable license to use ONERGY solely for your personal, non-commercial use, in accordance with:

• this Agreement, 
• Apple App Store Terms of Service, 
• Google Play Terms of Service.

You may not:

• modify, reverse engineer, decompile, or attempt to extract source code, 
• copy or redistribute the App, 
• bypass security mechanisms, 
• use the App for commercial activity unless explicitly permitted.

ONERGY and connected wearables (including BrainBit devices) are not medical devices and do not provide medical or diagnostic information.

The App:

• does not detect, prevent, or treat medical conditions, 
• provides wellness, relaxation, and self-awareness insights only, 
• is not a substitute for medical advice. 

Always seek professional medical assistance for any health-related concerns.

You are responsible for:

• maintaining the confidentiality of your login credentials,
• all activity occurring under your account, 
• providing accurate information. 

We may suspend or terminate your account if we suspect:

• misuse, 
• fraudulent activity, 
• violation of these Terms.

ONERGY may offer:

• free access with limited features, 
• paid subscriptions (“Pro”, “Plus” or other tiers), 
• promotional or limited-time offers.

 If you subscribe via Apple/Google:

• billing is handled by the respective platform,
• subscriptions automatically renew unless cancelled.

Refunds are managed only by Apple or Google under their policies.
We do not issue refunds directly.

We reserve the right to modify prices or features. Continued use after changes constitutes acceptance. 

The App may connect with supported wearable devices (e.g., BrainBit, BrainBit Calibri, or similar EEG/biofeedback hardware).

You agree that:

• third-party device performance is not our responsibility,
• data accuracy is not guaranteed, 
• we do not cover damage related to hardware use.

By using ONERGY, you consent to:

• collection and processing of usage data, 
• storage of meditation/biofeedback session history, 
• transmission of data to our servers or third-party processors. 

We do not sell personal data.

You may submit certain data (“User Content”), such as:

• meditation session logs,
• device readings,
• notes or reflections.

By submitting, you grant us a worldwide, non-exclusive, royalty-free license to use anonymized and aggregated data to:

• improve the App,
• conduct analytics and research,
• develop new features.

We never sell identifiable data.
